BeMyMentor – Terms & Conditions for Mentors

These Terms govern your participation as a Mentor on the BeMyMentor platform. By registering, you agree to comply with these Terms.

1. About the Platform

BeMyMentor connects industry experts with clients seeking mentorship or consulting. The Platform manages scheduling, payments, communication, and discovery, but it does not employ Mentors. You act as an independent professional using the Platform.

2. Eligibility

You must be at least 18 years of age. You must provide true and accurate personal and professional information. You must maintain updated profile details and use your personal login credentials without sharing them.

3. Platform Use & Code of Conduct

You must interact respectfully and professionally with all users. You must provide guidance honestly and ethically based on your expertise. You must keep all mentee information confidential. You must avoid offering medical, legal, financial, or other regulated advice unless you are qualified and permitted to do so. You must not contact mentees outside the Platform or share personal contact details. BeMyMentor may suspend or terminate your account in case of misuse or breach.

4. Sessions, Bookings & Payments

Your session fees are fixed by BeMyMentor and displayed to mentees. You will receive payment based on the Platform’s payout schedule after deduction of service charges and taxes, if applicable. You must honour all confirmed bookings. If you fail to attend a session, BeMyMentor may withhold payment for that session and may take corrective action. If a mentee does not join within 15 minutes, the session will be considered completed.

5. Communication

You must conduct all communication only through the Platform. BeMyMentor is not responsible for any conversation or exchange that occurs outside the Platform.

6. Third-Party Tools & Integrations

The Platform may use third-party apps for calls, scheduling, or file-sharing. BeMyMentor is not responsible for failures or disruptions caused by these tools. Your data may be used to improve Platform performance and personalise your mentor experience. BeMyMentor does not sell your data or share identifying details without permission.

7. Confidentiality & Data Protection

You must maintain strict confidentiality regarding all mentee information. You must not record or share session content without consent. BeMyMentor follows the DPDP Act 2023 and maintains secure data-handling practices. Confidentiality obligations continue for three years after your account is terminated.

8. Intellectual Property

Your personal content (presentations, frameworks, advice, training material) remains your intellectual property unless you expressly share ownership. Platform branding, software, and templates belong to BeMyMentor. You may not reverse-engineer or misuse Platform content.

9. Relationship Disclaimer

You act as an independent consultant and not an employee, partner, or agent of BeMyMentor. You are responsible for the accuracy and appropriateness of your guidance. BeMyMentor does not guarantee any number of bookings or earnings.

10. Fees, Taxes & Invoices

Your payouts are subject to tax regulations applicable in India. You are responsible for maintaining your tax compliance (GST, income tax, professional tax, etc.). BeMyMentor may request payment proofs or tax documentation.

11. Termination

BeMyMentor may suspend or terminate your mentorship privileges for misconduct, violation of Terms, misrepresentation, or unethical behaviour. After termination, your access will be revoked and pending payments may be reviewed. Data may be retained for 90 days for audit.

12. Limitation of Liability

BeMyMentor is not responsible for indirect or consequential damages. Your liability for your conduct rests solely with you. BeMyMentor’s total liability does not exceed the fees paid to you in the preceding three months. You agree to indemnify BeMyMentor against claims arising from your breach, misconduct, or incorrect advice.

13. Governing Law & Dispute Resolution

These Terms are governed by Indian law. Disputes must first be resolved amicably. Unresolved disputes will be handled through arbitration in Mumbai, in English, under the Arbitration and Conciliation Act, 1996. Courts in Mumbai have exclusive jurisdiction.

14. Miscellaneous

These Terms form the entire agreement between you and BeMyMentor. Any changes must be issued in writing by the Platform. Invalid clauses do not affect the enforceability of others. BeMyMentor is not liable for delays caused by force majeure events. Notices may be sent via email or registered post.
